Court Update: Emergency Motion for Reconsideration and On Talking to Police

Filed a motion for reconsideration with Judge Dennis J. Curran (folder, PDF).  Tricky Fitzpatrick filed his previous motion in a way that, effectively, mislead Judge Curran into thinking that I didn’t comply with discovery.  At least that’s the only semi-reasonable explanation that I can imagine for a Judge to allow a motion that effectively stops the judicial process on an indigent individual without so much as a hearing over award of fees in violation of Court’s rules of procedure (explanation in my motion).

Anyway, I will also be taking some other steps – lower courts are overseen by higher courts (wiki-law.com:Appeals)… As I learned after another hilarious half a day spent trying to get an answer out of court officials…  Funny how paranoid they are of the conversations being recorded, yet how they start behaving somewhat more professionally when you make sure to ask their name.

On a related note, here is a video where a cop and a lawyer both say “Don’t talk to police.” (YouTube)  This feels incredibly, fundamentally wrong that, rather than shed light on innocence and assist police in serving us, it is “safer” to not speak at all.  Ugh…  Need to remember to consider this in the future.
